GENERAL CONDITIONS OF SALE

These general terms and conditions of sale apply to all sales of ACT products to consumers via the website www.act-running.com. The customer's order implies acceptance of all of these general terms and conditions of sale; these prevail over all other general terms and conditions of sale unless expressly accepted by the seller.


THE ORDER

Items visible on the site are available while stocks last. In the event of an order being placed or payment being made for an unavailable item, ACT undertakes to offer a credit note or reimburse the customer within 15 days. ACT undertakes to notify by email any customer who has ordered an unavailable item.


PRICES AND PAYMENTS

The prices applicable to orders are those displayed on the website www.odaje.com at the time of the order. Prices are inclusive of VAT, excluding delivery charges, and are governed by French law. Prices may be modified at any time by the seller, without notice, particularly in the event of changes in tax or economic data. Ordered items must be paid in euros and online. Bank charges incurred by payment are the responsibility of the customer. Delivered goods remain the property of the seller until full payment. Online payment is made by credit card, or by using a PayPal payment account. The payment methods accepted via our secure Payplug platform are all Visa and MasterCard credit and debit cards, both European and international. This includes Electron (Visa) and Maestro (Mastercard) cards. We also accept all French CB network cards, even if they are not affiliated with Visa and MasterCard. The customer can also pay for their order via the secure PayPal platform. These platforms comply with the regulations of the networks of accepted cards in force.


BILLING

The invoice is sent to the customer at the address provided when ordering. The price is the one in effect at the time the customer places the order. ACT Running disclaims all liability for any errors in customer information entered when ordering.


DELIVERY AND TRANSPORT

Items are delivered within 1 to 7 business days from the order date throughout mainland France. This timeframe is given for information purposes only and may vary depending on item availability. Exceeding this timeframe may under no circumstances be held against ACT, nor give rise to termination of the contract or any compensation for damages. Beyond a period of one month from the order date, ACT will reimburse undelivered goods by check or bank transfer. Packages are delivered by post or express carrier to the address indicated when ordering. As such, ACT is unable to guarantee a specific delivery time. The transfer of risks occurs at the time of delivery of the goods. ACT cannot be held liable in the event of contractual non-performance resulting from a case of force majeure, including, but not limited to, war, riot, insurrection, interruption of transport, import problem, strike, shortage, fire, earthquake, storm, flood.


CONFORMITY AND DEFECTS

The goods must be inspected by the customer upon delivery. Any reservations should be noted on the delivery slip presented by the carrier or can be sent to run@act-running.com within 48 hours. This email address is protected from spambots. You need JavaScript enabled to view it. Complaints regarding visible defects in delivered goods will only be considered if notified by mail within 48 hours of delivery.

This shipment must include an explanatory letter from the customer and the goods in question in their original packaging. ACT undertakes to take back, exchange or refund any defective goods, without being liable for damages. Shipping costs are borne by the customer.


RIGHT OF WITHDRAWAL

For products purchased online, the customer has 15 working days from the date of purchase of the goods to exercise the right to withdraw from their order. The postmark or the date of the receipt of availability constitutes the starting point of this period. The return or cancellation may concern all or part of the order. Return costs are borne by ACT for all returns in France and the European Union (except for Switzerland). For all orders placed outside the European Union, returns are the responsibility of the customer. You can send your package to this address by adding your name, the reason for the return and your order number: ACT Running / 32 rue de Paradis, 75010 Paris, France. The refund, total or partial, will be made within a maximum of 15 working days following receipt by ACT of the returned goods. The refund will be made by bank transfer to the customer in accordance with the information provided when ordering. Products returned damaged, incomplete, soiled, or without their original packaging will not be accepted for return, exchange, or refund. Goods returned after 15 days from the date of purchase will not be accepted for return, exchange, or refund.
